1. Who we are

SocialSpark is operated by [your registered business name / sole proprietor name], South Africa ("SocialSpark", "we", "us"). Contact: jean@aopay.io. By creating an account you agree to these Terms and to our Privacy Policy.

2. The service

SocialSpark generates social media captions, post ideas and short video advertisements from photos and text you provide, using specialist third-party content-generation services. The service is intended for business use by persons 18 years or older.

3. Your account

• You are responsible for keeping your password confidential and for all activity on your account.
• Provide accurate information and keep it up to date.
• One account per business; accounts are not transferable.

4. Plans, billing and cancellation

• SocialSpark is a paid subscription service billed monthly in advance, in South African Rand, through PayFast. Your card details are processed by PayFast and never stored on our servers.
• Subscriptions renew automatically each month until cancelled. You can cancel at any time on the Plan & billing page; cancellation stops future charges.
• Prices and plan limits are shown on the Plan & billing page and may change with 30 days' notice by email.
• Fees already paid are not refunded for partial months, except where required by law.

5. Usage limits and credits

• Each plan includes a monthly number of caption, idea and video generations. Unused generations do not roll over.
• Each video render counts as one generation, including regenerations. If a video generation fails, the credit is automatically returned.
• We may apply fair-use safeguards to protect the service from abuse.

6. Your content

• You keep ownership of the photos, text and business information you upload.
• You grant us a limited licence to process your content (including sending it to our content-generation providers) solely to provide the service to you.
• You warrant that you have the necessary rights to the content you upload, including the consent of any identifiable people appearing in your photos.

7. Generated content

• Captions, ideas and videos are generated automatically by software and may contain errors. Review every caption and video before publishing. You are solely responsible for what you post, including the accuracy of prices, claims and promotions.
• Generated content is yours to use commercially. We do not guarantee that similar output will not be generated for other users.
• Generated output must not be used to create misleading, unlawful or infringing advertising.

8. Acceptable use

You may not use SocialSpark to create or distribute content that is unlawful, defamatory, hateful, sexually explicit, deceptive, or that infringes the rights of others; nor may you attempt to disrupt, reverse-engineer or gain unauthorised access to the service.

9. Availability and third-party services

The service depends on third-party content-generation and payment providers and is provided "as is" without warranties of uninterrupted availability. We may modify or discontinue features with reasonable notice.

10. Liability

To the maximum extent permitted by law (including the Consumer Protection Act where it applies), our total liability for any claim arising from the service is limited to the subscription fees you paid in the three months before the claim arose. We are not liable for indirect or consequential loss, including loss of profits or reputational harm arising from content you chose to publish.

11. Termination

You may delete your account at any time on the Plan & billing page, which erases your data as described in the Privacy Policy. We may suspend or terminate accounts that breach these Terms, with pro-rata refund of prepaid fees unless the breach was material.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app at least 30 days before they take effect. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any disputes.
